Bankruptcy Litigation and Avoidance Actions
Our lawyers have frequently been retained by bankruptcy trustees and liquidating trusts to pursue difficult claims for the benefit of insolvent estates’ creditors. These cases include complex avoidance actions, such as fraudulent transfers that appeared to be arms length transactions and unwinding restructuring transactions that disguised the improper repayment of antecedent debt. We have also frequently been retained to prosecute claims that belonged to the insolvent debtor pre-petition, such as breach of fiduciary duty claims against officers, directors or controlling shareholders. As a result of our attorneys’ efforts, estates that appeared to be hopelessly insolvent were able to pay a dividend to unsecured creditors.
